{"id":22295,"date":"2015-01-28T17:16:14","date_gmt":"2015-01-28T22:16:14","guid":{"rendered":"http:\/\/cfif.org\/v\/freedom_line_blog\/?p=22295"},"modified":"2015-01-28T17:16:14","modified_gmt":"2015-01-28T22:16:14","slug":"striking-down-obamacare-subsidies-in-some-states-would-end-individual-employer-mandates","status":"publish","type":"post","link":"https:\/\/cfif.org\/v\/freedom_line_blog\/22295\/striking-down-obamacare-subsidies-in-some-states-would-end-individual-employer-mandates\/","title":{"rendered":"Striking Down ObamaCare Subsidies in Some States Would End Individual, Employer Mandates"},"content":{"rendered":"<p>There are many ways to skin a cat, the saying goes, and there may be more than one way to frame the Supreme Court striking down the IRS\u2019 lawless extension of ObamaCare subsidies to an estimated 5 to 6 million Americans.<\/p>\n<p>If the Court invalidates the subsidies for people living in states without a state-run ObamaCare exchange \u2013 as a plain reading of the law requires \u2013 then the consequences will have a ripple effect.<\/p>\n<p>\u201cFor instance,\u201d columnist <a href=\"http:\/\/www.washingtonexaminer.com\/here-comes-the-next-obamacare-showdown\/article\/2559144?utm_campaign=Washington%20Examiner:%20Opinion%20Digest&amp;utm_source=Washington%20Examiner:%20Opinion%20Digest%20-%2001\/26\/15&amp;utm_medium=email \" target=\"_blank\">Philip Klein explains<\/a>, \u201cObamaCare\u2019s fines against employers that do not offer health insurance coverage are triggered when a worker claims government subsidies to purchase insurance on an exchange \u2013 but in states where workers can no longer legally receive those subsidies, then there are no fines. The employer mandate, thus, is effectively dead in those states.\u201d<\/p>\n<p>There\u2019s more.<\/p>\n<p>\u201cAdditionally,\u201d says Klein, \u201cthe individual mandate exempts those who can\u2019t find health insurance options for less than 8 percent of their income \u2013 thus, if the subsidies are eliminated, more people will be able to claim this exemption.\u201d<\/p>\n<p>In other words, if a lack of ObamaCare subsidies make individual health insurance unaffordable, then the individual and employer mandates are null and void.<\/p>\n<p>An ObamaCare without mandates weakens the law substantially, and makes it far more likely for Republicans to change. If the Supreme Court delivers a decision that brings it about, the GOP should be in a good position to enact a <a href=\"http:\/\/cfif.org\/v\/freedom_line_blog\/22272\/gop-congress-working-on-obamacare-alternative-if-subsidies-struck-down\/\" target=\"_blank\">more workable alternative<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>There are many ways to skin a cat, the saying goes, and there may be more than one way to frame the Supreme Court striking down the IRS\u2019 lawless extension of ObamaCare subsidies to an estimated 5 to 6 million Americans.
