{"id":2375,"date":"2009-11-30T16:36:14","date_gmt":"2009-11-30T21:36:14","guid":{"rendered":"http:\/\/cfif.org\/v\/freedom_line_blog\/?p=2375"},"modified":"2009-11-30T16:38:55","modified_gmt":"2009-11-30T21:38:55","slug":"aba-endorses-ny-gitmo-trials","status":"publish","type":"post","link":"https:\/\/cfif.org\/v\/freedom_line_blog\/2375\/aba-endorses-ny-gitmo-trials\/","title":{"rendered":"ABA Endorses NY Gitmo Trials"},"content":{"rendered":"<p>In the \u201cnot a big surprise\u201d news category, the ABA announced that <a href=\"http:\/\/www.abajournal.com\/files\/2009nov25_guantanamotrial_l.pdf\" target=\"_blank\"><span style=\"text-decoration: underline;\">it \u201csupports\u201d<\/span><\/a> Attorney General Eric Holder\u2019s decision to try some Gitmo detainees in New York federal court.<\/p>\n<p>Carolyn Lamm, President of the ABA (American Bar Association) and occasional <a href=\"http:\/\/www.foreignpolicy.com\/articles\/2009\/11\/13\/lowering_the_bar?page=0,2\" target=\"_blank\"><span style=\"text-decoration: underline;\">lobbyist for Uzbekistan<\/span><\/a>, wrote General Holder arguing that \u201c[t]he transfer of these high-profile cases to federal court affirms this nation\u2019s adherence to due process and the rule of law, and clearly establishes that these men are being tried as criminals, not as soldiers in armed conflict.\u201d<\/p>\n<p>CFIF has opined on these trials <a href=\"http:\/\/cfif.org\/v\/freedom_line_blog\/2277\/let-the-propaganda-begin\/\" target=\"_blank\"><span style=\"text-decoration: underline;\">here<\/span><\/a> and <a href=\"http:\/\/cfif.org\/v\/freedom_line_blog\/2096\/moral-confusion-on-the-potomac\/\" target=\"_blank\"><span style=\"text-decoration: underline;\">here<\/span><\/a>, and while the Gitmo detainees are clearly being treated as criminals now, are we not now in an \u201carmed conflict?\u201d\u00a0  How many Americans have died in Afghanistan because 9\/11 conspirators like Khalid Shiekh Mohammed decided to turn passenger jets into missiles? \u00a0  Would American conspirators in foreign countries be tried in civilian courts for engaging in acts of war?<\/p>\n<p>The ABA seeks \u201ccompetent assistance of counsel \u2026 due process \u2026 and [the right] to be treated as innocent until proven guilty\u201d for the Gitmo detainees.\u00a0  Let\u2019s hope they receive those rights without jeopardizing national security or turning a real trial into a spectacle that puts American foreign policy on the witness stand.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In the \u201cnot a big surprise\u201d news category, the ABA announced that it \u201csupports\u201d Attorney General Eric Holder\u2019s decision to try some Gitmo detainees in New York federal court.
