More Legal Shenanigans from the Biden Administration’s Department of Education

Among the foremost threats to individual freedom in America is the abusive and oftentimes lawless behavior of federal administrative agencies, whose vast armies of overpaid bureaucrats remain unaccountable for their excesses.

Among the most familiar examples of that bureaucratic abuse is the Department of Education (DOE).  Recall, for instance, the United States Supreme Court’s humiliating rebuke last year of the Biden DOE’s effort to shift hundreds of billions of dollars of student debt from the people who actually owed them onto the backs of American taxpayers.

Even now, despite that rebuke, the Biden DOE launched an alternative scheme last month in an end-around effort to achieve that same result.

Well, the Biden DOE is now attempting to shift tens of millions of dollars of…[more]

Afghanistan Collapse Shatters Biden’s Imbecilic Gun Control Narrative Print
By Timothy H. Lee
Thursday, August 26 2021
Anyone with the most rudimentary understanding of history would recognize the absurdity of suggesting that small arms are impotent against advanced military weaponry.

The casualties of Joe Biden’s incompetent Afghanistan debacle extend far beyond that nation’s borders.

Just seven months into his presidency, Biden’s ability to lead has evaporated both at home and overseas.  In terms of public trust, his approval rating has collapsed to 41% in a matter of days, and continues its downward trajectory.   Current and former leaders of allied nations, meanwhile, openly label his decisionmaking “shameful” and “imbecilic.”

Among friend and foe alike, who can consider him credible going forward?

A recurring rhetorical theme of Biden’s gun control agenda, which remained high among his presidential objectives, also just crumbled amid his Afghan catastrophe.  Here was what he had to say just two months ago:

The Second Amendment, from the day it was passed, limited the type of people who could own a gun and what type of weapon you could own.  You couldn’t buy a cannon.  Those who say the blood of lib… the blood of patriots, you know, and all the stuff about how we’re going to have to move against the government.  Well, the tree of liberty is not watered with the blood of patriots.  What’s happened is that there have never been… if you wanted or if you think you need to have weapons to take on the government, you need F-15s and maybe some nuclear weapons…

It didn’t take long for Biden’s taunt to come back and haunt him.  Under his watch, the primitive Taliban has just retaken the entire nation of Afghanistan without a single F-15, let alone nuclear weapons.

Not that Biden should’ve needed this latest corrective to steer him away from his off-the-cuff claim.  In his lifetime, a comparatively underarmed Viet Cong successfully held off the world’s most powerful military without possessing nuclear weapons or advanced fighter planes.

And was Biden somehow under the impression that a U.S. military that didn’t deploy nuclear weaponry against the Taliban, the Viet Cong or the North Korean army would somehow nuke everyday Americans in Dallas, Phoenix or Charlotte?

Moreover, how is it that Biden somehow overlooked the American Revolution, in which citizens with small arms defeated the world’s most powerful army of the era?

Anyone with the most rudimentary understanding of history would recognize the absurdity of suggesting that small arms are impotent against advanced military weaponry.

Biden’s claim was also so factually inaccurate that even The Washington Post “Fact Checker” gave it the dreaded Four Pinocchios:

In this case, he repeated a claim — that Americans were prohibited from owning cannons — that has already been fact-checked as false when he made it during the presidential campaign…  “Everything in that statement is wrong,” said David Kopel, the research director and Second Amendment project director at the Independence Institute.  After 1791, “there were no federal laws about the type of gun you could own, and no states limited the kind of gun you could own.”  Not until the early 1800s were there any efforts to pass restrictions on carrying concealed weapons, he said…

Interestingly, during the campaign, Biden had asserted that the cannon restrictions happened during the Revolutionary War.  “From the very beginning you weren’t allowed to have certain weapons,” Biden told Wired magazine in May 2020.  “You weren’t allowed to own a cannon during the Revolutionary War as an individual.”  Historians at the time told PolitiFact there was no evidence this was the case.  The Biden campaign could not point to any laws but seemed to suggest Biden’s point was more metaphorical than grounded in reality.  Now Biden has moved the cannon metaphor to some 20 years after the Revolutionary War – and it’s still wrong.

When even The Washington Post so astringently corrects Biden, you know he really stepped in it.

One might otherwise dismiss Biden’s misstatement as another in his endless litany of rhetorical blunders, but the Second Amendment’s right to keep and bear arms remains a literally life-and-death concern.  At a minimum, even according to an Obama Administration study, firearms are used to deter crime at least 500,000 times in America each year.  As violent crime continues to rise across the U.S. at record rates, the issue therefore maintains even greater importance each day.

As The Washington Post concluded, a president has a duty to play it straight in attempting to advance his political agenda:

Some readers might think this is a relatively inconsequential flub.  But we disagree.  Every U.S. president has a responsibility to get American history correct, especially when he’s using a supposed history lesson in service of a political objective.  The president’s push for more gun restrictions is an important part of his political platform, so he undercuts his cause when he cites faux facts.

It's tragic to watch an American president undermine the credibility of his office in the way that Biden has.  It’s even more tragic, however, if Americans allow a president to undercut our constitutional rights using such demonstrably false rhetoric.

Do you believe the U.S. Supreme Court will ultimately reject the new Biden administration automobile emissions rule as beyond the scope of administrative agency authority?
