A judge in New York has granted Dannon Company’s motion to dismiss a lawsuit filed against it that charged shoppers were misled by Dannon's "all-natural" claims in its dairy products. Polly Podpeskar sued Dannon for false advertising, noting that reasonable consumers would not expect a yogurt labeled "all-natural" to use milk from cows likely fed a diet containing genetically engineered soy or corn. Arguing that Podpeskar's logic "has not been adopted by the FDA and has been rejected by both courts and Congress," Dannon also noted that federal GMO labeling legislation passed by President Obama doesn't extend GMO labeling to products made from milk from animals fed GM feed. In its motion to dismiss the case, Dannon said no reasonable consumer would follow Podpeskar’s “daisy-chained” logic. —Source: foodnavigator-usa.com
