If the voting returns remain close, and there’s a recount of paper ballots Foreign Policy reports that it could be worse:

In The Gambia, a country in West Africa, each voter is given exactly one marble, which they place in one of the large marble collecting jars that are set up for each candidate.

“The polls workers are listening because when the marble goes into the jar, there’s a ding. And if there are two dings, maybe somebody came in with extra marbles in their pocket, so they call the police,” she said.

Asked how Gambians do a recount with the marble-based voting system, McCormick said, “I have no idea.”

Though buried at the end of an article, even the New York Times can’t hide the truth:

Still, the Republicans have had legitimate complaints, election officials say. Groups associated with the Democrats have sometimes been overly aggressive in voter registration, paying people for each voter registered or offering bonuses for larger numbers of registrations. This has led to fraud. Ms. Platten, the Democratic county elections board director, said she had seen multiple registrations for the same person whose Social Security number had been shifted by one digit.

“In the end, that hurts the Democrats,” she said, “because we throw those votes out. I’ve begged them to stop.”

Chances are they won’t, and we’ll be in for a long legal slog if the votes are close in swing states on Election Night.

In my column this week, I note that the Obama Administration refused to meet its legal requirement to publish its upcoming regulatory agenda back in April.  As of today, it failed to do so again in October as required by law. 

We’ve now gone an entire year without the Obama Administration giving Americans – and the businesses that employ them – the information they need to plan for the future.  In response, the job market is frozen and expansion projects are being delayed.  The only reason that makes sense for violating two disclosure requirements is that the White House is waiting until after Election Day to flood the economy with even more regulatory burdens.

If that’s not enough to spur a change, I don’t know what is.

Remember this story from Richard Rahn of the Cato Institute the next time you’re looking for an example of how ours is turning into a government of men, not laws:

Use of X-ray body scanners is an example of regulatory deception. If you work in the private sector and spend substantial time around machines or substances that emit radiation, you normally are required to wear tags that measure radiation doses. The Transportation Security Administration (TSA) has exempted itself from that requirement with the argument that the doses of radiation passengers and TSA employees receive from the X-ray body scanners (backscatters) at airports is so low as to cause no more than a trivial amount of extra cancers. They may well be right, but without measuring what employees and passengers actually receive from frequent and sometimes miscalibrated machines, no one knows for sure. Besides, the effect of radiation on the body is cumulative.

The European Union has prohibited backscatters, as have many countries, because of concern about health and safety. TSA has come under great criticism for the use of these machines, particularly when a safer and better technology is available. TSA has not admitted the danger but quietly has been replacing some of the backscatters with millimeter-wave scanners. These machines rely on low-energy radio waves like those in cell phones and thus are believed potentially not to damage a person’s DNA, unlike the backscatters. These new machines are faster because a computer analyzes the image, rather than a guard as with the X-ray machines. They are better at detection and provide greater personal privacy. Still, the question remains, why is TSA phasing out the X-ray machines so slowly and not providing its employees with radiation-detection tags? Private employers probably would be sued over such behavior.

If the Electoral College deadlocks at 269-269, Vice President Biden, in his role as President of the U.S. Senate, would get to decide the rules for picking the VP.  (The House would pick the President.)

Roll Call paints the picture:

One of the foremost experts on Senate rules said he sees no evidence of expedited procedures to avert a filibuster of that process.

“I have read the 12th Amendment to the Constitution, and I don’t see anything that requires the Senate to vote without debate on choosing a vice president,” former Senate Parliamentarian Robert B. Dove said. “Therefore, I don’t see what would stop Senators from speaking about who is going to be the vice president and, in effect, forcing a cloture vote.”

While the parliamentarian advises the presiding officer on procedural questions, Dove said, the responsibility to rule rests with the occupant of the chair. In the event of an Electoral College tie, that would be Biden (in his capacity of president of the Senate, until Jan. 20). Dove notes that Democratic Vice President Hubert H. Humphrey disregarded the parliamentarian’s guidance with some regularity.

Something tells me Good Ole’ Joe isn’t the kind to let a little conflict of interest get in the way of his hold on power.

Avik Roy, an outside health care policy advisor to the Romney campaign, reminds us why you should never trust a clever lawyer or accountant:

Obamacare was cleverly designed such that its most politically toxic provisions wouldn’t go into effect until after the election. In addition, the Obama administration spent billions of unauthorized taxpayer dollars this year and last so that the impact of its cuts wouldn’t be felt until after the election.

2013: Tax increases and Medicare cuts

Over the next ten years, Obamacare cuts $716 billion from the Medicare program in order to fund its $1.9 trillion in new health spending over the same period. $156 billion of those cuts come from the market-oriented Medicare Advantage program, and those Medicare Advantage cuts start to kick in in 2013. 27 percent of all seniors are enrolled in Medicare Advantage, including 32 percent in Wisconsin and 36 percent in Ohio.

I hope the Romney campaign has been hammering home the part about the Obama Administration hiding the true cost of Obamacare from voters in swing states like Wisconsin and Ohio through aggressive direct mail and ad buys in those states because people need to know that before they decide whether to renew the incumbent’s contract.

For my part, a White House that deliberately hides the truth behind unauthorized spending and delayed implementation timelines is one that can’t be trusted; now or in the future.

Here’s what the Vice President of the United States said at a campaign rally in Wisconsin:

“But you can’t erase what you’ve already done, they’ve voted to extend tax cuts for the very wealthy, giving a $500 trillion dollar tax-cut to 120,000 families.”

Remember, America, if reelected, Good Ole’ Joe is a heartbeat away from saying things like this from the Oval Office!

Byron York says when it comes to talking about America’s historically high poverty rate, “Barack Obama ignores the issue when it comes time to campaign. A sky-high poverty rate doesn’t fit his theme that things are getting better. So he doesn’t talk about it.”

“But the problem is still there. According to the Census Bureau, the poverty rate has gone from 12.5 percent in 2007 to 13.2 percent in 2008 to 14.3 percent in 2009 to 15.1 percent in 2010 to 15.0 percent in 2011. The last time it was higher than 15.1 percent was in 1965, when the nation’s anti-poverty programs were just taking effect.”

For all his pretensions about being the next FDR, it looks like President Obama’s tenure could signal the death knell for LBJ’s expensive and failed Great Society.

Politico: “A House committee’s lawsuit against Attorney General Eric Holder over his refusal to turn over some documents related to the fallout from Operation Fast and Furious will move forward at a faster pace than the parties requested, a federal judge ruled Wednesday.

“The Justice Department moved on Oct. 15 to throw out the lawsuit brought by the House Oversight and Government Reform Committee and agreed with the House panel that it’s lawyers could have two months to respond to that motion. However, U.S. District Court Judge Amy Berman Jackson rejected that proposal on Wednesday, saying that the House committee should file its response by Nov. 16.”

The quicker review means that the next step in the Fast and Furious scandal – whether President Obama can be compelled to hand over documents relating to the Mexican gun-running operation – won’t get buried in the last days of the lame duck session.

Good for Judge Berman.  America needs a timely resolution to this issue.

In case you haven’t read the Obama campaign’s 11-page brochure outlining the President’s (vague) agenda for a second term, A.B. Stoddard of The Hill saves you the trouble:

It’s not just that the plan is the first voters have heard of any Obama has for his second term — two weeks before Election Day — but that the brochure is about as cheesy a cheap shot as they come.

How, they asked the campaign, could the president possibly win a second term in such a tight race without having outlined an agenda for the next four years? And so an eleventh-hour glossy appeared to answer the charge that Obama had nothing in mind for 2013-2017, with pretty pictures and pabulum to prove it.

Paul Ryan couldn’t agree more.

Larry Kudlow: “…reporter Jeffrey H. Anderson uses a Treasury Department study to chronicle the 7-Eleven presidency. In fiscal year 2012, ending September 30, the government spent nearly $11 for every $7 of revenues taken in. The exact figures are $2.5 trillion in tax revenues and $3.5 trillion in spending. In other words, it spent 44 percent more than it had coming in. Previous fiscal years look even worse: The government spent 56 percent more than revenues in fiscal year 2011 and 60 percent more in fiscal year 2010.

“All in all, according to Mr. Anderson, the government under the Obama administration received $6.8 trillion in taxes and spent $10.7 trillion — 56 percent more than it had available.”

Repeat after me: The government doesn’t have a revenue problem.  It has a spending problem.

If you haven’t already seen it, the video of Illinois State Senate candidate Barbara Bellar’s single-sentence description of Obamacare is a hilariously accurate indictment of the Obama Administration that promoted it.

Robert Stacy McCain: “By highlighting the Libyan issue and adding a new element of controversy, however, Crowley inadvertently ensured that the administration’s failure in Benghazi will be the focus of post-debate news coverage — which is unlikely to improve Obama’s re-election chances.”

Indeed, every news site covering the presidential campaign has at least one entry mentioning the Libya story – none of it favorable to the Obama campaign.

And even though some are prone to think Mitt Romney missed his one great opportunity to skewer President Obama with the Libya debacle, Romney gets another chance.  The next and last debate is focused solely on foreign policy.

Wanna bet Mitt will be ready next time?

The Heritage Foundation tees up five issues that so far haven’t been mentioned in the Romney-Obama or Ryan-Biden matchups:

1)      Welfare Reform

2)      Trade

3)      Medicaid

4)      Federal Spending and Debt

5)      American-Produced Energy

Each of these is not only critical to American prosperity, but also conveniently is attached to a disastrous policy decision by the Obama Administration.

This summer Obama’s HHS gutted the work requirement for receiving welfare checks that was the hallmark of the mid-1990’s reform.

The President and his fellow liberals in Congress held hostage free trade agreements negotiated by the Bush Administration as a favor to labor unions, and in the process damaged our international standing.

Obamacare is scheduled to hit Medicaid doctors with a 19 percent pay cut starting in 2014.

This is the fourth consecutive year of $1 trillion budget deficits presided over by President Obama, and there is no indication the incumbent will do anything differently if reelected.

As for domestic energy production, Obama’s rejection of the Keystone XL pipeline angered not only consumers paying high gasoline prices, but also the unionized labor that stood to benefit from short- and long-term job creation.

Mitt Romney should look for ways to insert these failures of leadership into his answers during tonight’s townhall debate with Barack Obama.  People need to be reminded that the President’s kneejerk liberalism is bankrupting the country.

John Fund says that the White House blame-shifting for the Libya fiasco is causing a rift inside the Administration:

Obama officials may have made a key mistake when, in their panic, they attempted to lay blame for the Libyan fiasco solely on others. White House spokesman Jay Carney told reporters that responsibility for Libya lay with the State Department, not the White House. Ed Klein, a former New York Times editor who has authored recent biographies of both Hillary Clinton and Barack Obama, says his sources tell him that Bill Clinton is already pulling together an informal legal team to create a defense in case Obama officials continue to point the finger in Hillary’s direction.

“If she is left with this stain on her reputation, it could seriously damage her chances for election” as president in 2016, Klein told the Daily Caller.

So, after four years as a loyal Secretary of State, THIS is how Hillary Clinton gets rewarded by the man who beat her in the 2008 Democratic primaries?

Bill must be fuming.  Barack should beware a Bubba-eruption.

The Fox affiliate in D.C. reports that Carlos Slim, a Mexican telecom billionaire and at $70 billion the world’s richest man, is adding to his net worth by owning a controlling stake in a company that specializes in making $10 off of every “Obamaphone” it distributes to eligible Americans.

But although Slim himself is said to have donated to President Barack Obama’s reelection campaign, it’s the mogul’s American-based surrogate, Frederick “F.J.” Pollack, who seems to be greasing the skids.  Per Fox:

Pollak has donated at least $156,500 to Democratic candidates and committees this cycle, including at least $50,000 to the Obama campaign. His wife, Abigail, is a campaign bundler for Obama and has raised more than $632,000 for the president this cycle, and more than $1.5 million since 2007. She has personally contributed more than $200,000 to Democratic candidates and committees since 2008.

The Pollaks hosted Obama at their Miami Beach home in June for a $40,000-per-plate fundraising dinner, and hosted a similar event with Michelle Obama in July 2008. The couple personally donated a combined $66,200 to Obama’s re-election effort that year.

With 3.8 million customers receiving Obamaphones at $10 a pop, the Pollacks are getting several times their money’s worth for Slim in campaign donations.

“I think the vice president very well knows that sometimes the words don’t come out of your mouth the right way.”

True and well delivered.  The crowd loved it too.

Stephen Moore of the Wall Street Journal in an interview with the Daily Caller frames the tax debate in terms both Mitt Romney and Paul Ryan should use when attacking President Barack Obama’s soak-the-rich economic policies:

“Fairness is a good principle but should not be put ahead of growth,” Moore said when discussing his new book, Who’s the Fairest of Them All?: The Truth about Opportunity, Taxes, and Wealth in America.  “There’s nothing fair about making everyone poor.”

A hat tip to my father-in-law and former flight instructor Grady Conner for sending along a link from Flying Magazine that reproduced the National Business Aviation Association’s response to President Barack Obama’s debate night swipe at corporate jets:

In an open letter to Obama, NBAA head Ed Bolen said the remarks show that the president is out of touch with reality.

“Your comments seemed to illustrate a complete lack of understanding about the importance of business aviation in the U.S., and appear to be at odds with your stated interest in promoting job growth, stimulating exports, driving economic recovery and restoring America to its first-place position in manufacturing,” Bolen wrote.

Bolen was referring to Obama’s response to a question from debate moderator Jim Lehrer about tax policy, in which Obama stated: “Why wouldn’t we eliminate tax breaks for corporate jets? My attitude is if you got a corporate jet, you can probably afford to pay full freight, not get a special break for it.”

Bolen first countered those remarks in a statement issued to news organizations before the Wednesday night debate had concluded, which noted that the business aviation industry is responsible for 1.2 million American jobs, and contributes $150 billion annually to the U.S. economy.

For those scoring at home, the 1.2 million American jobs maintained by the business aviation industry dwarf the 300,000 non-farm payroll jobs created since President Obama took office.  (And that’s being charitable.  The CNN fact checkers who determined that number didn’t count government jobs.  If they had, the Obama economy would actually have 400,000 fewer Americans working today than in January 2009.)

As a devotee of stimulus, the President should appreciate that tax breaks for corporate jet purchases help stimulate people to buy such aircraft, which in turn help employ 1.2 million domestic workers and generate $150 billion.

Then again, maybe the President just resents the fact that free people in an open market can do a better job stimulating the economy than government experts.
